How to check a licensed recruitment agency in Mauritius
Choosing a licensed recruitment agency in Mauritius starts with checking who will carry out the recruitment, which licence category covers the work and what your agreement says. A familiar trading name or an overseas office is not enough to answer those questions.
The Private Recruitment Agencies Act 2023, the 2025 Regulations and the Ministry’s March 2026 employer guidelines provide the framework. Use the checks below before committing to a recruitment proposal, then resolve any discrepancy with the Recruitment Licence Unit.

When is a recruitment agency licence required?
The Act’s section 4 requires licensing for recruitment on an employer’s behalf in Mauritius, including where the operator holds a foreign recruitment licence. Read this alongside section 3: direct recruitment by an employer and labour contractors are exceptions to the Act’s general application, subject to the Ministry’s guidelines for non-citizen recruitment.
The employer guidelines say employers should generally use a licensed private recruitment agency for non-citizen workers. Exceptional direct recruitment needs the Permanent Secretary’s authorisation. An employer should establish the applicable route before starting recruitment rather than assume that handling the search internally removes these requirements.
The Regulations distinguish recruitment of Mauritian citizens locally, Mauritian citizens abroad and non-citizens for employment in Mauritius. For overseas non-citizen hires, check the third category. A foreign licence alone does not authorise recruitment operations in Mauritius.
How do you check the Ministry’s agency list?
Open the Ministry’s Recruitment Licence page and download its linked agency list. The version reviewed was dated 23 October 2026. Look in the non-citizen employment category and compare the legal name, address and validity dates with the agency’s documents. As a practical check, also compare the name on the agreement and invoice.
Treat the list as a dated reference. A missing name does not conclusively establish that a business has no current licence, and a future expiry date does not exclude an intervening suspension or revocation. Ask the Recruitment Licence Unit at pra@govmu.org to clarify missing entries or inconsistent details.
Under sections 10 and 11 of the Act, licences cannot be transferred and must be displayed with their conditions. The principal office must display the original; other business premises need a certified copy. Check current validity while recruitment continues. A renewal application is not itself a renewed licence.

Contact usWhat should you check in the recruitment agreement?
The Regulations and employer guidelines require a written employer–agency agreement using the Fourth Schedule terms. Review the services, recruitment timeframe, costs including travel, worker data protection, termination grounds and dispute procedure. Ask who will handle each stage and how progress will be documented.
Section 5 of the Private Recruitment Agencies Act 2023 assigns recruitment and travel costs to the employer and prohibits charging workers recruitment fees. The Private Recruitment Agencies Regulations 2025 expressly include round-trip tickets, police reports, passport issuance, visas, processing and work permit fees. Ensure the agreement addresses worker payments to intermediaries abroad as well as in Mauritius.
The Ministry of Labour and Industrial Relations’ Guidelines for Employers Recruiting a Non-Citizen Worker require the employment contract before deployment, with Fifth Schedule terms. It must be in three copies, in English or French and a language the worker understands. They require decent accommodation arrangements. Check the practical arrangements before agreeing to a recruitment plan.
Which warning signs need further enquiries?
Investigate requests for worker-paid recruitment costs, another company’s licence or passports held as security. The Regulations restrict withholding worker documents and require overseas recruitment partners to be legally authorised or accredited where they operate. Ask how the agency verifies those partners.
The Act prohibits misleading recruitment advertising. Ask what supports a proposed schedule and distinguish recruitment milestones from authority decisions. A fixed timeframe is not automatically unlawful, but a promise should have an explained basis.
Ask about support after arrival. The Private Recruitment Agencies Regulations 2025 require agency checks with the employer and worker at least once during the first three months after deployment, alongside ongoing employer due diligence. Record how concerns will be raised and followed up.
Frequently asked questions
Does absence from the Ministry’s list prove an agency is unlicensed?
No. The published PDF is a snapshot. Resolve the discrepancy with the Recruitment Licence Unit and verify the current licence and category before proceeding.
Can an employer recruit non-citizen workers directly?
The employer guidelines allow exceptional direct recruitment with the Permanent Secretary’s authorisation. Do not treat the Act’s direct-employer exception as unconditional permission to bypass those guidelines.
Who pays if a recruited worker must return home?
Responsibility depends on the circumstances. Section 16 of the Private Recruitment Agencies Act 2023 assigns specified repatriation cases, including medical unfitness and recruitment by misrepresentation, to the agency. The Ministry of Labour and Industrial Relations’ Guidelines for Employers Recruiting a Non-Citizen Worker separately identify employer-funded repatriation under the Sixth Schedule of the Private Recruitment Agencies Regulations 2025. Review both duties.
