Manpower consultancy or recruitment agency: what do Mauritius employers need?

Indian Ocean Millenium Partners, also trading as JNP Recruiting Services, operates as a manpower consultancy. It does not act as a licensed private recruitment agency under the Private Recruitment Agencies Act 2023. Recruitment and placement are carried out by the employer or a duly licensed agency, never by the consultancy.

Based in Vacoas-Phoenix, Mauritius, with offices in Kathmandu and Dubai, it advises on workforce planning and hiring preparation. Choose the lawful route before searching.

Consultancy meeting with an employer in Mauritius about hiring foreign workers

What can a manpower consultancy do?

It advises on staffing numbers, job specifications, hiring processes, Work Permit paperwork and candidate assessment methods. It helps employers plan direct recruitment or select a licensed agency and check that recruiters in Nepal and India are legally authorised there.

The service remains advisory. Section 2 defines recruitment activities broadly, including advertising, collecting biodata and submitting applications. A consultancy label does not exempt those activities from licensing. Assessment support covers criteria and employer-led evaluations, without recruiting for the employer.

When is a licensed agency needed, and can employers recruit directly?

Section 3(1) excludes an employer recruiting workers for itself from the Act’s general application. Section 3(2) subjects non-citizen recruitment to Ministry guidelines. The Employer Guidelines of 18 March 2026 generally expect a licensed agency; exceptional direct recruitment requires the Permanent Secretary’s authorisation.

Section 4(1), read with those exceptions, requires a licence for recruitment on an employer’s behalf. A foreign licence alone does not authorise operations in Mauritius. Check the Ministry’s licence list, the non-citizen category and current validity. Refer discrepancies to the Recruitment Licence Unit.

How does advisory support fit each hiring route?

  1. Brief and specification. Define roles, skills, headcount, pay and timing. Confirm direct-hire authorisation or select a licensed agency before recruitment begins.
  2. Local recruitment evidence. The employer documents local recruitment efforts and outcomes; the consultancy advises on the checklist.
  3. Assessment and paperwork. The employer or licensed agency conducts recruitment. The consultancy advises on assessment criteria and document gaps. The employer submits the ordinary Work Permit application through NELS.
  4. Contract and arrival. The employer arranges required contract vetting and gives the worker the employment contract before deployment, in three copies, in English or French and a language the worker understands. Plan accommodation, arrival and induction; advisory support does not replace employer or agency duties.

How should responsibilities and costs be divided?

Separate advisory and recruitment services in writing. For an agency hire, the employer and licensee enter the Fourth Schedule agreement required by Regulation 7. The employer retains employment and permit responsibilities; the agency retains its statutory recruitment duties.

Section 5 makes recruitment costs the employer’s responsibility: workers pay nothing for recruitment. Regulation 7 includes round-trip tickets, police reports, passports, visas, processing, Work Permit and annual fees. Do not recover recruitment costs through wage deductions.

Frequently asked questions

May a consultancy introduce candidates?

Do not assume an exemption. Introductions may involve recruitment activities under section 2. Confirm any proposed arrangement with the Ministry of Labour and Industrial Relations before proceeding.

Who signs with the worker?

The employer and worker sign the employment contract. The consultancy does not become the employer or placement agency.

Can the consultancy handle NELS filing?

It advises on preparation. For ordinary Work Permit applications, the employer or its CSG-listed employee submits. Confirm any proposed delegation with the Ministry of Labour and Industrial Relations.
