Direct recruitment Mauritius: preparing an employer file
Direct recruitment in Mauritius is an exceptional route for non-citizen workers covered by the Ministry's Guidelines of 18 March 2026. Employers should generally use a duly licensed Private Recruitment Agency. Direct recruitment requires authorisation from the Permanent Secretary of the Ministry of Labour and Industrial Relations.
Indian Ocean Millenium Partners, also trading as JNP Recruiting Services, is a manpower consultancy. It advises employers on organising an authorisation file and choosing a licensed agency. The employer remains responsible for the request and hiring decision.
Last reviewed October 2026. Rules change, so confirm the current requirements with the authorities before you apply.

Which route applies?
Section 3 of the Private Recruitment Agencies Act 2023 exempts employers recruiting for their own workforce from the Act, subject to section 3(2). Under section 3(2), recruitment of non-citizens other than non-citizen residents must follow Ministry guidelines. Confirm any exemption with the Ministry.
The March Guidelines and the communiqué of 6 May 2026 require employers to use a duly licensed agency unless exceptional direct recruitment is authorised. If you use an agency, check that its licence is valid and covers non-citizen employment. Enter into the written employer-agency agreement required by the Private Recruitment Agencies Regulations 2025.
What does the May warning mean?
The communiqué warns companies and persons carrying out recruitment activities without the required authorisation or licence. Section 4(4) of the Act provides for, on conviction for contravening section 4, a fine of at least Rs 500,000 and no more than Rs 1,000,000, and imprisonment for up to 5 years.
These penalties apply to section 4 offenders, including unlicensed intermediaries. Requesting authorisation does not itself incur a penalty. Section 2 defines recruitment activities broadly, including advertising, collecting biodata and submitting recruitment applications. Calling a service consultancy does not remove licensing requirements.

Organise your evidence and planned safeguards before requesting authorisation. The Guidelines set out employer duties. The February 2026 Work Permit Information Sheet lists evidence for the permit process. Neither provides this list as an authorisation checklist. Ask the Ministry which attachments your request needs.
- Business justification: Keep a statement of your workforce need and why you are requesting exceptional direct recruitment (good practice). The Guidelines do not list this statement as a required attachment. Ask the Ministry whether to include it.
- Role specification: Record the duties in a separate role sheet (good practice). Keep clear, fair and non-discriminatory selection criteria (required by the Guidelines).
- Local recruitment evidence: Keep the Employment Information Centre vacancy report, Mauritiusjobs advertisements and evidence that no suitable local candidate was found (Work Permit Information Sheet).
- Worker fee protection: Budget for the employer to pay all recruitment costs and ensure workers are not charged recruitment fees or related costs abroad (required by the Guidelines). Keep a cost ledger and payment evidence to demonstrate this protection (good practice).
- Employment contract: Prepare the contract in triplicate in English or French and in a language the worker understands, with the Fifth Schedule terms. Arrange for it to be explained and accepted in writing before departure. Prepare orientation materials in the worker's native language and keep completed confirmations when available (required by the Guidelines).
- Accommodation: Plan decent accommodation (required by the Guidelines). Keep the lodging accommodation permit, evidence that its procedure has started, or the accommodation letter applicable to the worker's category (Work Permit Information Sheet).
- Policy and records: Keep documented ethical recruitment procedures and comprehensive recruitment, selection and hiring records. Make them available to the Ministry on request. Cover origin-country compliance, authorised overseas intermediaries where used, worker document protection and access to grievance procedures (required by the Guidelines).
How should the request and decision be recorded?
You can send your request by email to employment@govmu.org, by post or by hand, as set out in the Guidelines. Address it to the Permanent Secretary, Ministry of Labour and Industrial Relations, Employment Division, 11th Floor, Victoria House, Port Louis. Ask the Ministry to confirm current submission requirements. As good practice, keep a decision log:
- Before submission: Record the route considered, reasons, responsible employer manager and evidence still missing.
- During review: Save the request, dated correspondence and answers to Ministry queries. A sent request is not authorisation.
- After the decision: Keep the Ministry's response and any conditions. Confirm their scope before proceeding. Authorisation does not replace Work Permit requirements; record those separately.
How can a consultancy help?
A manpower consultancy can advise on the file structure, job criteria, cost planning and licensed agency checks. Indian Ocean Millenium Partners holds no recruitment licence and does not recruit workers. The employer prepares and submits its request, implements safeguards and retains responsibility for compliance.
Frequently asked questions
Can an employer simply recruit directly?
